It's supposed to. The fines probably vary from state to state (in the UK it's up to £5000). There must also be provision in the law to allow people to recover costs.(There must be an individual right to recover compensation.)

EU Directive 2002/58/EC requires member states to prohibit the sending of unsolicited commercial e-mail.

Extract below:

2.2. Enforcement provisions
The provisions of the ‘general’ Data Protection Directive on judicial remedies, liability and sanctions are applicable to the provisions of the Directive on Privacy and Electronic
Communication, including the provisions on unsolicited communications.

In short, Member States must ensure that penalties and remedies are in place for infringements. An individual right to a judicial remedy must be provided for any breach of the rights provided under national law. While this judicial remedy is without prejudice to any (possibly prior) administrative procedures, there is no harmonised requirement to provide for such administrative procedures. There must be an individual right to a compensation for any damage suffered as a result of any unlawful processing or act.

There must be sanctions to be imposed in case of infringements, which ensure full implementation of the Directive...

As is generally the case for a irective, enforcement of the provisions lies with Member States in the first place, not with the Commission. For instance it is not for the Commission to prosecute, or impose fines on, those who infringe the rights and obligations provided in the Directive.

and Miryamwotsit's site appears to be hosted by <a href="http://www.aquamediabelgium.com" Target="_BLANK">www.aquamediabelgium.com</a> so it may well be a Belgian site - highly amenable to Belgian law.
We could all just go to the site and visit the "contact us" page. They have a "yahoo" email address (very professional indeed!). Then we all send a decent sized file to the address. Their email inbox should soon fill up!!

Somebody tried to 'hack' my computer in the UK from a skynet.be IP address a couple of weeks ago.

I reported the attack to Skynet and I've just received a reply saying that they've traced the hacker and will be dealing with him <img src="../images/emoticons/ysmile.gif">

They're the only ISP who have responded to attack reports - it seem that Belgium is serious about computer mischief.

Seriously, as a Skynet user I am impressed with their service and this is welcome news.

Strange how the Aquamedia site is owned by a certain 'Anabel Rosas' while the au pair site is registered to 'Miryam Aubert' (both at the same address) -- could Miryam Rosas actually be two people?
