Hi Guys,

I am new here and already need your help... smile.gif

I am Hungarian and have a 5 yr resident permit (I have been living in Belgium since March, 2008).
My boyfriend is Nigerian and he has an "article 9 document" (he can stay in Belgium, but cannot travel oustide of Belgium and cannot work either).
We are getting married in July, we went through a whole lot of stuff... Police checks, interview, etc - but everything is fine, we have the date and the neccessary aprovals.

The question is: what kind of document is he going to get?
We went to the commune to ask, but they were not sure, they mentioned the orange card but someone said there is no orange card anymore... I have been trying to call the helpdesk at the immigration office, but it is always busy.

We really need to know, because
a, he needs to start working ASAP
b, after getting married we want to travel to Hungary for 1-2 weeks


Once we get the marriage documents, we will go to the commune right away, bu the question is, do we have to wait till he has something? Or will they give a document what he can use immediately, even for travelling? Do not forget, Hungary is in Schengen...

Please, if you have any good info on this one, let me know.

Also called the commune and could talk to them and they said he would get an "oranga card" and would not be able to travle with it, but according to the link I just copied, he could, if he is travelling with me and has a resident permit. Or is the orange card not a resident permit?

Please, please help!

This is not an easy question for anyone to answer that is not in fact an expert in this area of Law in Belgium. There is so much depending on so many circumstances i.e. too many parameters to speak of. Your embassy should in fact guide you on this, or his, as this is part of their role. You can also go to someone like am-pm relocations and they will deal with this - but may charge a fee. You can call 01.658.9490 - speak to Anita and let her know that you I directed you to her (I am Chalks).

From my experience of many years in Belgium, without a full permit to live or work in Belgium, a proper ID card and the marriage certificate - any travel will be made complicated and potentially risky. The tendency (and I probably should not say this) is that there is little help to do things right - but plenty of people waiting for you to get it wrong.

Your husband will get an "F Card" if you prove legal marriage and legal residence on your part. An F Card is not valid for travel in even Schengen, it is an identity document for Belgium, although you may be able to cross borders in Schengen and it challenged, try and use the F card and marriage certificate and joint travel. F card is for non EU nationals legally dependent on an EU national legally resident in Belgium. Sounds like your boyfriend is an asylum seeker though, if correct, he is most likely to have to wrthdraw his claim before being able to get an F card.
Please be very very careful, this is such a common scenario to hear and often ends in tears, even if it seems genuine.
