Full Version: VISA REFUSAL FOR TOURIST AND FIANCEE

To All People Concern,,,

I am Andrea from Philippines, I come this site for one and most specific reason is to get acquianted to those people whom one on the other way can help me in resolving my case/situation with regards to VISA matter.

We been applying 3 times already for my TOURIST VISA in going to BELGIUM but unfortunately, I was been denied 3 times as well,so we decide together with my partner (he is a Belgian National) to get a FIANCEE VISA lately but unfortunately it was denied as well. I don't know what to do and we don't know what we need to do. We don't have the right person to contact from BELGIUM with regard to this matter. Is really unfair to my side as ASIAN and to my partner, its really a traumatic experience to me. One foremost reason, the Ministry don't give specific reasons for the refusal of visa, they just give general statement which is in any case not reasonable for us.

Does anyone from here, can help me in resolving and giving me new hope, to do the best and legal way to be with my partner in BELGIUM.

I suggest you Belgian partner contacts me so we can something out for you if he is willing to come and live about four months in The Netherlands.

Already married?
In this case apply for the Dutch Schengen visa for a tourist trip to The Netherlands with your husband.

Nope we are not married yet, but the marriage was already applied last MArch in his community in Belgium, that is the reason why we are applying for a FIANCEE VISA as for me when i get there to arrnage the marriage. But the problem is my FIANCEE VISA was denied, so that is why I am seeking assitance/advice here on what we will do instead as for em to be there as soon as possible.

First, the post has been moved to the Belgian section of the forum.

Your future husband could consult with local authorities, social services or whatever cheap legal help is available for Belgian subjects.

I live in the Netherlands, and I don't know much of the Beglian rules about that. It is now up to people who know something about that to answer your post.

Why did you apply for a tourist visa when you knew you were going to get married. That alone is reason for refusal. If you had plans to enter Begium on a tourist visa to get married, that is illegal. Therefore, any further visas could be rejected, even a fiance visa.

Hello Andrea,

How long did you know each other? sometimes the embassy are strict about the period of relationship. Does your boyfriend already came to Philippines to be with you? It should be several times he needs to come and see you perhaps twice a year and always take photos of you together and also your family with him. The next time that your BF will come back to see you he should appear to the embassy together with you and all the documents that the embassy required from you. So that the person from the embassy will see that two of you are working hard for you to get your visa. Keep all the emails and phone calls it all serve as evidence for your relationship.

Woah. What?

I'm a Canadian national, living with a belgian. We're planning on moving to Belgium in September - i was planning on coming in on my automatic 90 day shengen visa, then applying for a long term co-habitation visa, but we're also thinking about getting married.

Are you suggesting that if I came in on a 90 day shengen visa and married her before applying for the co-hab visa that I would be doing something illegal??????!!!??

NO! This is only for people who require a visa to enter the country at all; but Canadians (and people from the U.S.) can apply at the commune for a cohabitant or marriage visa because they are exempt from the tourist visa and can have a stay of up to 90 days. I think maybe you posted in the other forum - so I have a feeling you might already know this.

Belgium is very strickt regarding the fake marriage between Belgians and people from other countries so if embassy suspected that you want to marry Belgian becuase of work permit, visa could have been denied.

However please note that even if your application is denied, the consulate is obliged by the law
1. To provide you with reason in writing
2. To inform you about the possibility of appeal
