My partner is a US-born Belgian citizen and I am Venezuelan. We want to get married in Belgium so we can live together. He has never lived in Belgium neither have I. I went to the Belgian embassy here in Caracas and they told us that first he need to be registered in one of the communities so we can get married there. I need info on how to do this, how long it will take before he can apply for a marriage license etc. Someone told us that the police would come to his place to verify he lives there etc. Moving right ow is not an option since we have an apt. rented here in Caracas and cannot break the lease and take off. We want to get married in Brussels and really don't know what to do, any information about the process will be appreciated. Thanks

Unfortunately, your partner will have to establish a residence in Belgium first before you can move here. This is because you are not married and as you probably know, there are only four countries where gays can get married (in heterosexual terms): the Netherlands, Belgium, Spain and Canada. I believe Canada is the only country that doesn't include residency as a requirement to get a marriage contract. I know that the Netherlands requires at least one partner to be a resident as well, but check Spain.

My suggestion is to get married in Canada and use this marriage document to apply to relocate to Belgium as a couple. Being married, you'll be treated as heterosexuals who can easily move to any country albeit you'll be restricted to countries that recognise gay marriage.

I'm a Canadian and I'm been through this but with a different circumstance, since my partner, who is an EU citizen, relocated here because of his job. Canada didn't have a gay marriage then when we applied for residency in Brussels, and as such we were treated as common-law partners. Thus, we have gone through some bureaucratic process including applying for temporary residence, work permit, etc. In the end, we got married in Brussels and I got my permanent residence permit after six months.
